27. Long post, but important considerations for fighting this ruling : Press freedom is embedded in the First Amendment. All criminal court cases fall under the public's right to know, with the exception of crimes involving minors, & America's the only country that requires open courts, meant as a mechanism for the public accountability, as both a check on power, and preventing the abuses the Founders saw under British colonial closed-court system. Only civil court (with major limitations) and family court can close courtroom to the public. Judge Boyce knows this. In criminal court, generally, only the Defense files a motion to restrict media coverage — which must be waived unless they can demonstrate that cameras will make it impossible for them to have a fair trial. Unless a judge is insane, Juries are sequestered — meaning it's impossible for media coverage to influence the outcome.

    The rights of the victims, represented by their surviving family, cannot be trampled-on in the interest of one criminal serial killer defendant. Neither can the rights of the public in our democratic court system designed to always remain open to the public, nor can press freedoms be impugned in the sole interest of a singular criminal defendant simply because she has a powerful TAXFUNDED attorney. This appeal really needs to be made to the taxpayers of Rexburg, Fremont County, Madison County, and Idaho — who are PAYING for Lori's TWO private practice attorneys filing motions to block THEM from their right to know what's happening in this criminal trial. Call out this court's clear prejudicial hypocrisy: playing to the whims of the Defense attorneys. When it was Mark Means, EVERYTHING was not only filmed, but LIVESTREAMED, because it's what he wanted at a time when broadcasting frivolous Defense Motion (intentionally delaying trial & threatening to bankrupt the city), that should've been dismissed outright (or handled in Chambers), but instead Judge indulged each and every one with a HEARING — allowing the Defense to publicly air unfounded allegations & conspiracy theories outside of a forum for objection. This ran counter to the interests of the victims, the public, and served to benefit the Defense. Despite the Judge knowing their M.O. he continued to indulge these Motions & Livestream. But now that complying with public's right to know, press freedom, and victim advocacy has become "inconvenient" for the Defense now that they're going to Trial where they can't control the narrative — the Judge is AGAIN bowing to the whims of the Defense. He does not serve the Defense — so why is he?? The victims' advocates and half the Defense are fine with cameras — thus there is NO cause to grant a Motion filed by one Defendant at any cost. The city can't afford to get tied up in the coming civil litigation from the media, required to right this Judge's wrong. This abuse of power and clear bias towards Lori's Attorneys must be called out and examined.

    I hope everyone notes that when media-loving Mark Means was Lori's attorney, absolutely every little hearing motion over Zoom was publicly broadcasted. The only thing that's changed between now and then, is Lori got a high-powered Attorney via the LDS church's Head of Legal, whom she spoke to while allegedly "restoring her sanity." She has two lawyers, both funded by taxpayers via loophole allowing private law firms to profit off of cities with underfunded Public Defender's Office (like Rexburg). Obviously, this is far more of a burden on taxpayers than properly funding the PD's Office! Anyways, THIS is how LDS HQ was able to covertly get Lori a high powered attorney that'll put protecting LDS's reputation above Justice. I hope everyone also recalls that Rob Wood had been encouraging Lori to "get a better lawyer," since that secret recording by Summer Shiflet… And per East Idaho News, Wood continued advocating for Lori speak to LDS leadership in Utah… Which she did while "hospitalized" on an "unfit to stand trial" motion he withdrew his opposition to without explanation, denying the state from having an independent psychologist evaluate Lori before allowing her to leave Jail for nearly a year… All funded by taxpayers, with trial delays and new motions likely making this the most expense trial in Idaho history.

    Recently Judges in several other long-awaited criminal trials likely to reveal either police misconduct that enabled the crime(s) to occur, or the extent of the culpability by other uncharged co-conspirators (this case has BOTH elements) — have been siding with Defense motions to not only completely ban cameras from the trial, but many have recently made headlines banning the following (in violation of state & federal law):
    – Banning audio recording of trial — even for media (massive overreach that's grueling to reporters forced to solely rely on their notes, causing them to miss/not record much of the trial)
    – All out bans of electronic devices from entering the courtroom whatsoever (this is illegal in most states — cellphones are always allowed so long as they're on silent & not used inside courtroom, plus invasion of privacy for reporters & family members to handover electronics to baliffs at the door into courtroom)
    – Banning MEDIA altogether & only allowing in immediate family members of each sides — checking IDs, controlling & tracking lists of attendees.

    THIS is ILLEGAL absolutely anywhere in this country, yet Judges get away with it until media companies or press freedom orgs spend thousands suing to open an illegally closed courtroom. This mechanism successfully creates a secret "closed" court, with zero accountability, as lawsuits race against the clock, sometimes having to appeal to the state supreme Court. It's inevitable that judge's ruling will be overturned — something these criminal court judges know — but the lack of Judicial oversight gives each judge unlimited power, and the only way to "enforce" the laws these judges are knowingly violating, is to spend thousands of dollars suing the court (judge is insulated from personal liability/culpability).

    No matter how many times the court gets sued for the same violation of rights, and/or by the same Judge, there's no mechanism for accountability, and NO way to sanction, limit, or fire a Judge from any circuit. Only public release of something humiliating or unethical, is enough to get Judges to resign — and we usually see only this shady behind-the-scenes "Kompromat" operation take place when a powerful defendant is trying to remove a Judge unwilling to bend to their will. Add to that the fact that wealthy politically connected defendants openly "shop for Judges" that'll dismiss lawsuits against them (civil) and/or deny admission of key evidence by either prosecutor or innocent defendant being wrongfully charged (criminal court).

    This runs contrary to the law Judges swear an oath to apply equally to all. The local taxpayers need to be made aware, and all family members victimized by Chad and Lori should jointly sue the court to allow cameras. It's not enough to go on camera or submit a signed petition to a biased Judge who knows exactly what he's doing wrong. Only a higher Judge can order a Judge to reverse their unethical, and potentially prejudicial, ruling. There must be accountability. This Judge has allowed so much disinfo to air, misconduct between prosecution and defense behind closed doors to go unchecked, and has cost tax payers tens to hundreds of thousands for granting every single frivolous Defense Motion a Hearing. He can't allow livestreaming of Motions that should've been dismissed, then ban cameras from the only thing that matters: THE TRIAL. Stop coddling the Judge & Prosecution. They're not doing their jobs, they're both putting this case in jeopardy, and delaying the trial any further will only strengthen the Defense, given Prosecutors stopped all Investigations nearly 2 years ago & have refused to charge a single co-conspirator or related crime like Attempted Murder of Brandon Beaudraux!!
